WELCOME TO GRAYSTONE BANK’S INTERNET BANKING. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THIS SITE AND UTILIZING ANY OF THE SERVICES OFFERED, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW.
In this Agreement and Disclosure, the words "you", "your" and "yours" mean each and every one of you who utilizes Graystone Bank’s Internet Banking Services. The words "we", "us", "our", and "Bank" each mean Graystone Bank.
A. Account Eligibility Requirements
1. In order to activate your Graystone Bank Internet Banking Services, you must have at least one eligible account with us. "Eligible Accounts" include any Graystone Bank Checking account or Savings Account.
2. By enrolling in Graystone Bank’s Internet Banking Services you will be given access to all eligible Graystone Bank Accounts of which you are an owner, unless the account you wish to access requires two or more signatures. Accounts requiring more than one signature are not eligible for transfers of money between accounts using this service.
3. You must also designate a password at least 7 characters in length with a max of 17– which requires at least 6 alpha characters and 1 numeric character. You may be asked to change your password from time to time for security reasons. You should keep your password in a secure location. Any person having access to your Graystone Bank’s Internet Banking Services User Name and password will be able to access Graystone Bank’s Internet Banking Services and perform all transactions, including reviewing account information and making transfers to other accounts and possibly have access to bill pay merchants. 4. By initiating inquiries and/or funds transfers through the Graystone Bank’s Internet Banking Services, or by permitting another to use Graystone Bank’s Internet Banking Services on your behalf, you acknowledge receipt of this Agreement and Disclosure and agree to be bound by all terms and conditions contained herein, and all applicable terms and conditions contained in our other agreements with you governing your checking, savings, and loan accounts accessible in connection with this service. You further agree to follow all instructions provided by Graystone Bank’s Internet Banking Services as reflected on your computer monitor or other system access screen. 5. Any User Name that has been inactive for 180 days will be deleted. Inactivity is defined as a user name that has not accessed the system for the previous 180 days. If your user name is deleted, you will need to stop into one of our branches or contact customer service at 1-866-graystone.
A. Graystone Bank’s Internet Banking Services shall be accessible 24 hours a day, seven days a week. Any transfer between your accounts that is completed before 7:00 P.M. (EST) on a business day is posted to your account on the same day. Any transfer completed after 7:00 P.M. (EST) on a business day or at any time on a Saturday, Sunday or banking holiday will be posted on the next business day. Our business days are Monday through Friday. Holidays are not included. Graystone Bank’s Internet Banking Services may be inaccessible for a reasonable period on a daily basis for system maintenance Without limiting any other disclosure or liability limitation contained in this Agreement, we shall not be liable for any damage or injury arising out of failure to provide access to your accounts or your ability or inability to transact or engage in other Graystone Bank’s Internet Banking Services or any errors in or failure to complete transactions through the Graystone Bank’s Internet Banking Services site due to a system failure at the Bank or at an Internet provider, or due to other unforeseen acts beyond the reasonable control of the Bank. Your access to Graystone Bank’s Internet Banking Services shall be determined by the sole discretion of the Bank. Subject to applicable law, the Bank reserves the right to modify, suspend, or terminate access to the Graystone Bank’s Internet Banking Services at any time and for any reason without notice.
B. You can use Graystone Bank’s Internet Banking Services to access your accounts. Our Internet Banking Services will allow you to:
C. LIMITS ON TRANSFERS AND TRANSACTIONS:
There are no limits on the number or value of transactions you may initiate through Graystone Bank’s Internet Banking Services except as stated below, provided collected funds are available in your account or sufficient credit is available on your line of credit. You cannot initiate transfers using Graystone Bank’s Internet Banking Services to or from Certificate or IRA accounts, or any restricted accounts. Overdraft protection (if any) is NOT automatically triggered to cover "insufficient funds" transactions. We reserve the right to limit the frequency and dollar amount of any transactions at any time for security reasons.
D. TRANSACTION LIMITATIONS ON SAVINGS AND MONEY MARKET ACCOUNTS:
You are allowed a total of only six (6) withdrawals and transfers by telephone transfers, personal computer transfers or preauthorized debits per calendar month or monthly statement cycle from your Savings or Money Market accounts under the same account. No more than three (3) of the six (6) transfers may be payable to third parties. If you exceed these limits, we may charge you an "excess transaction" fee and your account may be subject to closure. You may transfer any available balance, unless limited under another agreement. These transfer and withdrawal limitations do not apply to transactions conducted at ATMs, in person, or by mail. Also, internal transfers to make payments to your Bank loans are excluded from this limitation.
E. FEES AND CHARGES:
There is no fee for Graystone Bank’s Internet Banking Services. However, you are solely responsible for the payment of any Internet Service Provider, telephone and utility company charges incurred in connection with accessing Graystone Bank’s Internet Banking Services.
F. DOCUMENTATION:
Your completed online banking transactions will appear on your periodic account statements. You will get a monthly account statement on the electronic funds transfer activity on your accounts unless there are no transfers in a particular month. In any case, you will get a statement at least quarterly. Be sure to review and verify all statement information thoroughly. You may also obtain information on transfers and payments by inquiry of your transactional account history using online banking.
G. RIGHT TO STOP PAYMENT ON ELECTRONIC TRANSFERS:
A Stop Payment order cannot be placed once a Graystone Bank’s Internet Banking Services transfer has been initiated by you and accepted by the system, or a bill payment transfer has been made and your account has been debited on the scheduled payment date. If you have made a transfer in error, you must reverse the transaction by initiating a correcting transfer. (Note: Transfers cannot be corrected via Graystone Bank’s Internet Banking Services when made as transfer/payments to closed-end loan accounts. Contact the bank if you require reversal of these transactions or need additional assistance.)
Stop payment of a check is different than cancellation of an online transfer. Graystone Bank’s Internet Banking Services does provide the ability to place a stop payment order on a check you have written. To be effective, your stop payment request must identify the name of the payee, the check number, the amount, and the date of the check. If you make your stop payment request online, we may also require you to put your request in writing and send it to us via U.S. mail within 14 days after your call. You will incur stop payment fees as disclosed in our current schedule of fees for the applicable account. The Bank will not be bound by this order until it has had sufficient time to act upon your request. Written stop payment orders are automatically released at the expiration of six months from the date of the order unless renewed in writing.
H. CONTACT INFORMATION:
If you believe your password has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call us at the telephone number or address listed below. You may also contact us in person at any one of our branch offices. Notification by electronic mail or in paper copy alone will not constitute effective notice. If you think your statement is wrong or if you need more information about a transaction listed on the statement, contact us by telephone at 1-866-graystone or 717-231-2700 during normal customer service hours or via email through Graystone Bank’s Internet Banking Services at customerservice@graystonebank.com, or write us as soon as you can at: Graystone Bank 112 Market Street, Harrisburg, PA 17101.
I. DISCLOSURE OF ACCOUNT INFORMATION TO THIRD PARTIES:
We will disclose information to third parties about your account or the transfers you make: (1) Where it is necessary for completing transfers; or (2) In order to comply with government agency or court orders; or (3) In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or (4) If you give us your written permission.
A. Consumer rights and responsibilities under Regulation E
1. Authorized use of Graystone Bank’s Internet Banking Services by other persons: You are responsible for keeping your password and account data confidential. The Bank is entitled to act on transaction instructions received using your password, and you agree the use of your password will have the same effect as your signature in authorizing transactions. If you authorize other persons to use your password in any manner, your authorization shall be considered unlimited in amount and manner until you have notified us in writing that you have revoked the authorization (and changed your password), and you are responsible for any transactions made by such persons and the Bank shall not be liable for any damages or injury arising out of or resulting from any unauthorized use of your password, unless and until you notify us that transactions by that person are no longer authorized (and we have a reasonable opportunity to act upon the change of your password).
2. Reporting Unauthorized Transactions. You should notify us AT ONCE if you believe your password has been lost or stolen (or that someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account). If you do not notify us promptly, it is possible that you could lose all the money in your account (plus your maximum overdraft line of credit). To notify us, call us at 1-866-GRAYSTONE OR 717-231-2700 during normal customer service hours. Notification by electronic mail or in paper copy alone will not constitute effective notice under this Section. a) Consumer Liability for Unauthorized transactions:
(1) Federal law requires that if you believe your password has been lost or stolen and you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50 if someone used your PIN without your permission. (2) If you do NOT tell us within two (2) business days after you learn of the loss or theft of your password, and we can prove that we could have stopped someone from using your password without your permission if you had told us, you could lose as much as $500. (3) Also, if your statement shows transactions that you did not make, tell us at once. If you do not tell us within 60 days after the FIRST statement showing such a transaction was mailed to you, you may not get back any money you lost after the 60 days, if we can prove that we could have stopped someone from taking the money if you had told us in time. Your role is extremely important in the prevention of any wrongful use of your account. You must promptly examine your account statement upon receipt. If you find that your records and ours disagree, you must call us at 1-866-GRAYSTONE or 717-231-2700.
b) Resolving Errors or Problems
(1) If you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt, contact us as soon as you can by telephone at 1-866-GRAYSTONE or 717-231-2700. (2) Graystone Bank’s Internet Banking Services or via email through customerservice@graystonebank.com , or write us at: Graystone Bank 112 Market Street, Harrisburg, PA 17101. (3) We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared. When you contact us, our representative will need to know the following information: Your name and account number A description of the error or the transaction you are unsure about An explanation of why you believe it is an error or why you need more information The dollar amount of the suspected error (4) If you tell us orally (or by electronic communication), we may require that you send us your complaint or question in writing within ten (10) business days. We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account. If we decide that there was no error, we will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.
c) Other consumer rights and obligations
(1) Maintaining accounts
(a) You agree to properly maintain any accounts you have with the Bank and to comply with the Terms and Conditions governing these accounts
(b) TERMINATION AND AUTOMATIC DEACTIVATION OF SERVICE: You may terminate your Graystone Bank’s Internet Banking Services at any time by providing written notice to the bank and immediately discontinuing use of the service, or by discontinuing use of the service (by not logging on to the service) for a six-consecutive-month period. You are solely responsible for notifying any participating merchants (when applicable) that you have terminated your bill payment transfer capabilities. If you do not utilize Graystone Bank’s Internet Banking Services, by not logging on to the service for six consecutive months, and your access to the Service will automatically be deactivated. If this occurs and you wish to reactivate your Graystone Bank’s Internet Banking Services, you must contact the bank by telephone or in person. We reserve the right to require reapplication before we reactivate your Graystone Bank’s Internet Banking Services system access. The bank may also terminate the Graystone Bank’s Internet Banking Services and this Agreement and Disclosure at any time by giving you advance notification, either orally or in writing. Whether you or the bank terminates your Graystone Bank’s Internet Banking Services and this Agreement and Disclosure, the termination shall not affect your obligations under this Agreement and Disclosure for any transfers or payments made prior to termination.
(c) ENFORCEMENT: You agree to be liable to the bank for any liability, loss, or expense as provided in this Agreement that the bank incurs as a result of any dispute involving your accounts or services. You authorize the bank to deduct any such liability, loss, or expense from your account without prior notice to you. In the event either party brings a legal action to enforce this Agreement or collect any overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to laws of the Commonwealth of Pennsylvania, to payment by the other party of its reasonable attorney's fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions, if applicable. Should any one or more provisions of this Agreement be determined illegal or unenforceable in any relevant jurisdiction, then such provision may be modified by the proper court, if possible, but only to the extent necessary to make the provision enforceable, and any such modification shall not affect any other provision of this Agreement.
(d) By your use of Graystone Bank’s Internet Banking Services, you acknowledge that the Graystone Bank’s Internet Banking Services may not perform as you intend, notwithstanding any efforts of the Bank, software providers, information or internet service providers or you.
A. Bank's rights and responsibilities under Regulation E:
1. SYSTEM UNAVAILABILITY: : Access to Graystone Bank’s Internet Banking Services may be unavailable at times for the following reasons: (1) Scheduled Maintenance - there will be necessary periods when systems require maintenance or upgrades; (2) Unscheduled Maintenance - Graystone Bank’s Internet Banking Services may be unavailable when unforeseen maintenance is necessary; (3) System Outages - major unforeseen events, such as, but not limited to, earthquakes, fires, floods, computer failures, interruptions in telephone service, or electrical outages, may cause system unavailability; or, (4) Internet Service Provider - failure by or unavailability of an Internet Service Provider. We will make all reasonable efforts to ensure the availability of Graystone Bank’s Internet Banking Services; however, we are in no way liable for system unavailability or any consequential damages that may result.
2. Changes in terms and other amendments: The Bank reserves the right to amend, add or remove portions of the Terms and Conditions of Use at any time. If any such amendment results in greater cost or liability to you or stricter limitations on the frequency or dollar amounts of transfers, we will give you at least 30 days notice by mailing a copy of the amendment to you at your most recent address shown on our records or, if you have previously agreed, by providing a notice delivered to the last email address you have provided us. Otherwise, the Bank will not provide you with advance notice of any amendments to the Terms and Conditions of Use. The Bank recommends that you check these Terms and Conditions of Use from time to time. You shall be deemed to have accepted any changes we make to the Terms and Conditions of Use if you use Graystone Bank’s Internet Banking Services at any time after such changes have been made.
3. Except as provided in Section III.b., the Bank is not liable for any damages or injury you may suffer or incur arising out of or relating to Graystone Bank’s Site or the Graystone Bank’s Internet Banking Services, including, without limitation, damages or injury caused by: any performance or failure to perform; error; omission; interruption; deletion; defect; transmission delay; operational delay; service interruptions; communications failure; theft; destruction; unauthorized access to, use or alteration of your information; computer viruses or other software related problems; or inaccuracies, errors or unreliable information on Graystone Bank’s Site, whether resulting wholly or in part from the Bank's breach of contract, negligent acts or omissions, other tortuous conduct or for any other reason. Without limiting the generality of the foregoing, the Bank shall not be liable for any consequential, indirect, special, incidental or punitive damages, that may arise out of or relate to your use or access of, or your inability to use or access, Graystone Bank’s Site or the Graystone Bank’s Internet Banking Services, or the transactions processed or attempted to be processed through Graystone Bank’s Site, even if the Bank has been advised of the possibility of such damages. If you live in a state that prohibits limitations or exclusions of liability or of certain damages, the foregoing limitation may not apply to you.
4. NEITHER THE BANK, SOFTWARE SUPPLIERS NOR ANY INFORMATION PROVIDERS MAKE ANY WARRANTY, EXPRESS OR IMPLIED, TO YOU CONCERNING THE SOFTWARE, EQUIPMENT, BROWSER, GRAYSTONE BANK SITE OR GRAYSTONE BANK’S INTERNET BANKING SERVICES, ALL OF WHICH ARE PROVIDED "AS IS, WHERE IS". THE BANK HEREBY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS. YOUR USE OF GRAYSTONE BANK SITE AND GRAYSTONE BANK’S INTERNET BANKING SERVICES IS AT YOUR OWN RISK.
5. The Bank desires and intends for the information contained in Graystone Bank Site to be accurate, correct and reliable, but, without limiting the generality of the foregoing warranty disclaimer, the Bank does not warrant, and it specifically disclaims any warranty, that Graystone Bank Site will contain accurate, correct and reliable information, Graystone Bank’s Internet Banking Services that it will be uninterrupted or error-free or that Graystone Bank’s Site or its web servers will be free from computer viruses or software-related problems.
A. Your Graystone Bank’s Internet Banking Services remain in effect until terminated by you or us. You may cancel your Graystone Bank’s Internet Banking Services at any time by notifying us of your intent to cancel via email, or calling 1-866-GRAYSTONEor 717-231-2700 or writing to us at: Graystone Bank 112 Market Street Harrisburg, PA 17101
B. This cancellation applies only to your Graystone Bank’s Internet Banking Services and does not terminate your other relationships with us. We may terminate your participation in the Graystone Bank’s Internet Banking Services for any reason, at any time. We will try to notify you in advance, but we are not obliged to do so.
A. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR THE ACCOUNTS COVERED BY THIS AGREEMENT, INCLUDING, BUT NOT LIMITED TO, A CLAIM BASED ON OR ARISING FROM AN ALLEGED TORT, SHALL AT YOUR OR OUR REQUEST, BE DETERMINED BY ARBITRATION UNDER THE AUSPICES AND RULES OF THE AMERICAN ARBITRATION ASSOCIATION AND IN ACCORDANCE WITH THE FEDERAL ARBITRATION ACT AND ANY APPLICABLE STATE ARBITRATION ACTS.
B. Judgment upon the award rendered by the arbitrator may be entered in any court having Jurisdiction. All statutes of limitation, which would otherwise be applicable, shall apply to any arbitration proceeding.
You may use Graystone Bank’s Site for your personal use only. You may not create a link from your website to Graystone Bank’s Site or redeliver any of the pages, text, graphic images or content of Graystone Bank’s Site using framing technology, without the Bank's prior written consent. You may not copy, reproduce, republish, transmit, display, modify, distribute or otherwise transfer the Bank's logos, or the pages, text, content or graphic images on Graystone Bank’s Site in any way, except as specifically provided in this section.
Important information about procedures for opening a new account - To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, driver's license and other information that will allow us to identify you. We may also ask for other forms of identifying documents.

By submitting an application online you are authorizing and consenting to Graystone Bank obtaining credit reports in connection with your application, using the information to evaluate your application, for consideration of other accounts and services and any other lawful purpose. In order to establish a Graystone Bank account online, you must be a U.S. citizen or U.S. resident with a valid Social Security Number and U.S. residence address. Additionally, you may not be eligible for any Graystone Bank accounts and services based on your geographic location, and therefore Graystone Bank reserves the right to determine eligibility for any product or service.
Funds Availability Policy - Our general policy is to allow you to withdraw funds deposited in your account on the next business day after we receive your deposit. Funds from electronic direct deposits will be available on the day we receive the deposit. In some cases, we may delay your ability to withdraw funds beyond the next business day. Then, the funds will be available by the fifth business day after the day of deposit.
A. LIMITATION OF LIABILITY:
In order to provide you with this service, Graystone Bank is unable to accept liability for any conduct, acts or omissions at this website or any losses you may incur. In no event shall Graystone Bank be liable for any damages (including without limitation any direct, indirect, special, incidental, or consequential damages), losses or expenses that arise in connection with the website, the use of the website, or the inability of anyone to use the website, or for any claims by any third parties. Graystone Bank shall also not be liable for any damages, losses or expenses that arise in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, or computer or system failure. Graystone Bank shall not be liable for such damages, losses or expenses even though it or its representatives are advised of the possibility of such damages, losses or expenses.
B. VIOLATIONS/INDEMNIFICATION:
Your access privileges are conditioned on your adherence to the terms discussed here. If you violate any of the terms of this agreement, you agree that Graystone Bank may deny you access to the website. You further agree, at your own expense, to defend and indemnify Graystone Bank and hold Graystone Bank harmless against all claims arising in any manner whatsoever which may be asserted against Graystone Bank, and all losses arising on any manner whatsoever and incurred as a result of any violations of this agreement. If asked to do so, you agree that you will not attempt to access this website.
C. Electronic notice:
Through the use of equipment or software, you can use electronic mail (email) to contact us about inquiries, maintenance and/or problem resolution issues. Email may not be a secure method of communication over the Internet. Thus we recommend you do not send confidential information by email. There may be times when you need to speak with someone immediately (especially to report a lost or stolen PIN, or to stop a payment). In these cases, do not use email. D. Business Days and Hours of Operation:
"Business days" means Monday through Friday, excluding Saturday, Sunday and federal banking holidays set forth under the laws of the United States. A Bank representative is available to assist you each Business day from 8:00 a.m. to 5:00 p.m. (EST) by calling 1-866-GRAYSTONE or 717-231-2700.
E. Governing Law:
This Agreement shall be construed in accordance with and governed by the laws of the Commonwealth of Pennsylvania without regard to choice on conflicts of law principles. Users of Graystone Bank’s Internet Banking Services acknowledge that all transactions must comply with the laws of the United States, including without limitation economic sanctions administered by the U.S. Treasury Department's Office of Foreign Assets Control (OFAC).
F. If any provision of these Terms and Conditions of Use are declared or deemed to be unlawful, unenforceable or void for any reason, then that provision shall be deemed severable from these Terms and Conditions of Use and will not affect the validity or enforceability of the remaining provisions.
G. Waiver of Jury Trial:
IN ANY LITIGATION IN WHICH THE PARTIES ARE ADVERSE, THE PARTIES AGREE TO WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY.
